December 30, 2014 — Murder Book covers the Brink murders

Investigation Discovery’s Murder Book tonight has chronicled the solution to the 1987 murders of Gail and Rick Brink. That has set off a wave of searches and some people are landing here. I saw it and thought the story telling very well done. It was good to see Detectives Venus Repper and Dave Blakely (retired), and assistant prosecutor Lee Fisher have a chance to articulate how they solved the crime. That solution started with the meticulous keeping of notes and evidence, photos and observations of the initial investigators. That’s where Venus made her crucial first observation of a photo that revealed to her that whoever killed Gail was close to her. I am grateful they were able to make the case. But what a case! As Dave Blakely said at the end of the program, this was a tragedy. But their work at last brought justice.

With the announcement of the arrests of Aurelias Jualious Marshall, 56, of Grand Rapids, on a charge of open murder and the arrests of Malcolm Xavier Jeffries 47, of Wyoming, Acey Marshall, 51, of Lithonia, Ga., and Sheila Reed, 57, of Grand Rapids on charges of perjury, Kent County Prosecutor Bill Forsyth says the end is in sight for solving the 1990 murder of 23-year-old Joel Battaglia. Aurelius Marshall was arraigned Friday, Dec. 19.

Battaglia was killed in the early morning hours of June 11, 1990, after he left Mulligan’s, an Eastown bar, and as he walked westward on Lake Drive. He was beaten to death before 1065 Lake; the fatal blow at the back of his head fractured his skull. Battaglia had also been beaten in his face, and his hands exhibited defensive wounds.

In the summer of 1990, Reed—with her children—lived across the street from the scene of the murder. Reed had told detectives that she heard something she described as “white voices” across the street, looked out, and went back to bed.

Shortly after the murder, Joel’s parents, Gail and Jerry, walked the neighborhood, meeting with residents. They asked Sheila Reed for her help in solving their son’s murder. She gave them no assistance.

At some point in the upcoming court process we’re likely to learn the links between Reed and the others.

The maximum penalty for perjury in a felony murder case is life in prison. The habitual offender notice could further enhance the penalty, up to twice the term for a fourth notice offender (that includes Jeffries, and Reed; Acey Marshall is a third offense habitual offender; Aurelius Marshall is a second offense habitual offender).

Preliminary hearing for Aurelius Marshall is scheduled for Friday Jan. 2, 2015. The case was originally under the direction of Detectives Gary Crum and Dave Benison. Before it was picked up again for this latest investigation by Detectives Pat Needham and Erik Boillat (who worked with Kent County Assistant Prosecutor Kellee Koncki), the case had been worked by the Kent Metro Cold Case Team and had been put before a grand jury.

December 19, 2014 — Aurelias Marshall arraigned for the murder of Joel Battaglia

Yes. That happened today a little after 1:30 p.m. before 61st District Court Judge Jennifer Faber. And all that came after a 10 a.m. press conference this morning at the Grand Rapids Police Department. I was there for both, and both are now widely disseminated on our regional media. This has been a day…and as much as I wanted what I have filmed posted, it will take time; I had to play a concert tonight for the Salvation Army–as I will tomorrow morning at 11–so everything will have to wait, wait, wait. A one-man band sometimes marches slowly.

Today was wonderful day, beyond all measure, in relation to Joel’s story. And there is much I want to say. I’m sorry but it’s doing to take a little time. Still and all: YES!

December 16, 2014 — Bail authorized for Jones brothers

Accused murderers Matthew (Skip) and Paul Jones were given bail by 27th Circuit Court Chief Judge Anthony A. Monton. Brothers Matt and Paul are accused of the 1989 murder of Shannon Marie Siders. According to the court, “Paul Jones was given $750,000.00 bond and Matthew Jones was given $500,000.00 bond.” Both bonds are cash or surety; that means that if the bail bonds are sought 25 percent must be plunked down.

Court was in session yesterday afternoon for Judge Monton to hear oral arguments on a 404B hearing, an application by the prosecution to allow behavior by the brothers that is not directly related to the case into the trial for consideration. This would fall under an exception to the prohibition of admitting other bad acts. Bob Siders said the judge heard arguments and said he will rule on the issues.

The next scheduled hearing will be the final pretrial on April 6, 2015 at 2 p.m. The trial is scheduled to begin April 20.
